USCIS Issues Policy Guidance Regarding Inadmissibility Based on Membership in a Totalitarian Party

On Oct. 2, USCIS issued policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. Membership in or affiliation with the Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America, which includes pledging to “support and defend the Constitution and laws of the United States.”

The new policy manual section provides guidance on how to adjudicate inadmissibility due to membership in the Communist Party or any other totalitarian party in the context of adjustment of status applications.

In general, unless otherwise exempt, any intending immigrant who is a member or affiliate of the Communist Party or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. This addition to the policy manual will help officers adjudicate this inadmissibility ground consistent with federal law.

SUBJECT: Inadmissibility Based on Membership in a Totalitarian Party

**Purpose **

U.S. Citizenship and Immigration Services (USCIS) is issuing policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist or any other totalitarian party.

**Background **

The inadmissibility ground for membership in or affiliation with the Communist or any other totalitarian party  1 is part of a broader set of laws passed by Congress to address threats to the safety and security of the United States.  2 In general, unless otherwise exempt, any immigrant who is or has been a member of or affiliated with the Communist or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. This ground of inadmissibility only applies to aliens seeking immigrant status, such as aliens inside the United States applying to adjust status to that of a lawful permanent resident.

This guidance, contained in Volume 8 of the Policy Manual, is controlling and supersedes any related prior guidance on the topic.

**Policy Highlights **

• Provides guidance regarding the ground of inadmissibility based on membership in or affiliation with the Communist or any other totalitarian party, and USCIS determinations on membership in or affiliation with such an organization. 
• Provides a step-by-step overview of the inadmissibility determination, as well as guidance on evidence and burden of proof, and applicable exceptions and waivers.

就怕這個exempt 有時候一個法官解釋出來~~ 比如我赞助一个依親移民申请 而且被申请人是我的直系親屬 我和我的律師在廳上拿出有“有力”證據 證明我這個親人必須跟我團聚
估計現在不少移民律師 做大陸人移民生意的 都在徹夜研究

第一章
团员
第一条　年龄在十四周岁以上，二十八周岁以下的中国青年，承认团的章程，愿意参加团的一个组织并在其中积极工作、执行团的决议和按期交纳团费的，可以申请加入中国共产主义青年团。
团员年满二十八周岁，没有担任团内职务，应该办理离团手续。
团员加入共产党以后仍保留团籍，年满二十八周岁，没有在团内担任职务，不再保留团籍。

也就是说

共青团员在28岁之前可以被称为affliate，因为要缴纳团费，而且根据章程有义务promising of support

我们也可以伸出手，为中共解体出一份力。

在我们年幼纯真，被中共欺骗而加入了它（党、团、队）。虽然可能什么坏事都没有干。

很多人之所以敢干坏事的话，就觉得这个党很强大嘛。所以至少，你在这个党中的话，你就成了壮大这个党的一个份子。同时的话，那么这个党及其组织做的事情自然就有你的一份。

所以就是从这个道德上来讲的话，就是应该声明退出，给自己良心的一个交代。

其次，马克思说过，共产主义是幽灵，这个党是个邪教。你加入邪教之后的话，这个邪教就给了你一个标志。《圣经启示录》它会在你的额头上做一个记号。

天灭中共是历史的必然。我们知道宇宙的法理是公平的。无论谁做了什么都得自己承担。种瓜得瓜，种豆得豆。

生命是可贵的，是最值得珍惜的，稀里糊涂地为共产主义买了单，也对不起父母、子女和自己！
